This document contains information about the activities of 3D Lab Academy EOOD, and the general conditions for use of the products provided by 3D Lab Academy EOOD, regulating the relations between us and each of our Users. Confirmation of the General Terms and Conditions is a necessary and mandatory condition for concluding the contract between the User and 3D Lab Academy EOOD.

By accepting the General Terms and Conditions, the User agrees to have his personal data processed on the basis of the contract concluded between him and 3D Lab Academy EOOD. The processing of personal data is done in accordance with the Privacy Policy of the Site-3dlab.bg.

 

Definitions

For the purposes of these general terms and conditions, the following terms shall be understood as follows:

User – is any natural person / legal entity that acquires goods or uses services from www.3dlab.bg.

General Terms and Conditions – these General Terms and Conditions govern the relationship between 3D Lab Academy EOOD and the Users.

Training – Online video tutorials, files, media, photos, codes and similar resources in the field of 3D visualization and design.

Product/s – Everything for sale and you can download from 3dlab.bg – 3D models, textures, HDRI, Freebies, etc. The products purchased from the market are digital products.

Market – A platform that contains all products in 3dlab.bg.

Personal data – information about an individual that reveals his physical, psychological, mental, family, economic, cultural or social identity.

 

Concluding a training contract

3D Lab Academy Ltd. offers its Users Training in the field of 3D visualizations and design. In order to use the offered Trainings, the Users must create a training request. For this purpose the User registers on the site 3dlab.bg.

For registration on the site, the User provides an email address. In order to make a request for purchase of Training it is necessary for the User to choose a specific Training, to enter the following data – email, names, phone, invoice data of a legal entity, choice of payment method, to declare with confirmation of acquaintance and consent with the content of these General Terms and Conditions and the conditions for Confidentiality of personal data by checking the appropriate fields.

After successful payment of the training fee, the User will have access to the Training.

The data described above are mandatory for the purposes of registration, for creating a User profile and for concluding a Training Contract. The Training Contract is considered concluded from the moment of sending by 3D Lab Academy EOOD an e-mail message confirming the registration for training of the User, which e-mail is sent to the e-mail address specified by the User.

All conditions, such as access, technical requirements and price are described on the registration page of each Training.

 

Concluding a contract for ordering products from CG Market

3D Lab Academy Ltd. offers its users digital products. “Product” and “Products” is everything that is offered in the Market of 3dlab.bg and can be downloaded from 3dlab.bg – 3D models, textures, HDRI, Freebies, scripts and the like.

In order to purchase a product from the market, a user needs to register on the site and request a purchase. In order to make a request for the purchase of a Product it is necessary for the User to select a specific Product / s and to enter the following data – email, names, telephone, invoice data of a legal entity, choice of payment method, to declare with confirmation of acquaintance and consent to the content of these General Terms and Conditions and the conditions for Confidentiality of personal data by checking the appropriate fields.

Payment Methods, Pricing and Payment Processor

After registration on the site 3dlab.bg and an order for the purchase of a Product and / or Training, Users must choose one of the following payment methods:

  • Credit / debit card payment – when choosing a credit / debit card payment, a payment page will open where you enter your card details – card type, card number, validity and CVV2 / CVC2 code – the last three digits of the number , written in the signature field of the card. If you are registered in the Verified by VISA or MasterCard SecureCode authentication schemes, an authentication page opens where you enter your authentication password. Please note that your V PAY or MasterCard Electronic card will only be accepted if it is registered to participate in the Verified by Visa or MasterCard SecureCode online authentication schemes. When paying by card, the money is deducted from the “Purchase (PURCHASE)” transaction – immediately.

To protect you from abuse when paying with your Visa or MasterCard, we apply the best practices recommended by international card organizations:

  • The security when entering and transferring the card data is ensured by using the SSL protocol for encrypting the connection between our server and the payment page of our servicing bank.
  • The authenticity of your card is verified by entering a security code (CVV2)
  • In addition, to identify you as a cardholder, the payment server for e-commerce of our servicing bank supports the authentication schemes of international card organizations

– Verified by VISA and MasterCard SecureCode, in case you are registered to use them.

Bank transfer – you receive a pro forma payment, which will describe our bank details. As a basis for payment, you must write down the number of the proforma invoice for which you pay. Payment can be made at a physical branch of a bank, or if you have active online banking, you could also make an online transfer. As soon as the payment is reflected in our system, the User will have access to the Training or to the Product from the Market. Depending on the servicing bank of the User, it is possible to have a delay of the transfer up to three working days;

The main currency in the Site is Bulgarian Lev. All prices of the products are final and all taxes / fees are included. The presentation of the base currency (Bulgarian lev) in another currency (eg euro or dollar) has only a presentational and orientational purpose for the value, as the currency conversion is automatic and the final transaction is always in Bulgarian lev.

Some products may be available to you for free, while other products may be purchased for a fee. You agree that you are solely responsible for all fees associated with purchases you make on the Site. If you wish to purchase a Product, we may, for your convenience, provide a link on the Site to a payment processor that will process your payment for such product (“Payment Processor”). Please note that the Payment Processor is a product of a Third Party and that the use of the Payment Processor website and related services is governed by the terms and conditions of the Payment Processor and not by these Terms of 3D Lab Academy Ltd. does not bear any way of responsibility for the General Terms and Conditions of the Payment Processor. We recommend that you read the terms and conditions of the Payment Processor before making purchases. You agree that 3D Lab Academy Ltd. reserves the right to add or remove payment processing methods at its sole discretion and without notice to you.

Refunds and claims

Our main goal is that what you buy from the site 3dlab.bg will be useful and valuable for you. You can write to us at [email protected], with your good reasons, within 14 days of purchasing a product from the market (3D models and textures) and within 30 days of purchasing Training with a request to recover the amount. Describe the exact cause and we will try to fix the original problem. Sometimes it can be our technical error related to many aspects of the finalization of the product, which we can easily eliminate and you get the final product for which you paid with eliminated errors.

The next option is to offer you a similar product with which you can replace the product you want to return. We guarantee a full refund and refund only in cases where the ordered product has errors that we can not eliminate or when we can not help in any other way to eliminate the problem, or the product itself is described with large differences from the actual parameters, where you may be misled about the content. In case of wrong purchase of a product, we can offer replacement with a correct one.

Points received for rewarding from our loyalty program – 3D Lab Union, which are accumulated as “gems” based on a product returned in this way, will be removed from the relevant buyer profile.

Please note that 3D Lab reserves the right to limit or deny the right to a refund for products that are not defective or purchased more than 14 days before 3D models and textures or 30 days for training before requesting a refund.

 

Disclaimer of Warranties

The Site and the products available through the Site and all other information, content, software, documents, and related graphics used on the Site may include technical inaccuracies, errors, or omissions. periodic changes to the information can also be made here.

3D Lab Academy Ltd. and / or its subsidiaries and affiliates may, but are not obliged to make any changes and improvements to the site, the products available through the site and any other information, content, service, software , product (s), documents and / or programs at any time.

Changing the prices of the goods

3D Lab Academy Ltd. has the right to change prices at its discretion at any time without prior notice to users. Intellectual Property Rights-Training

During the use of the site 3dlab.bg,, the User will have access to various materials, including written texts, audio and video content, graphic images, photographs, diagrams, drawings, sketches, source codes and the like. Regardless of whether it is a paid training or a free course from the site 3dlab.bg, these materials are protected objects of intellectual property according to the Bulgarian legislation, the holder of which is 3D Lab Academy EOOD. For this reason, the User may use the materials provided to him only for the purposes of his training in 3dlab.bg, and he is obliged to stop using them after the termination of the contract between the parties. In connection with the protection of the above intellectual property, the User has no right on its own or on behalf of others to display, advertise, reproduce, use, store, translate, process, publicly present, and / or copy, in whole or in part, the materials provided to him, without the prior written consent of 3D Lab Academy EOOD.

Video tutorials are protected by copyright. Downloading the lessons for personal use or their distribution is interpreted as a violation of the copyright of 3D Lab Academy EOOD.

Upon finding a violation of copyright, 3D Lab Academy Ltd. has the right to sanction users who violate the rights, and may deactivate a user profile, prevent the use of courses and the issuance of certificates to users who have downloaded the lessons for personal use or distribution. .

Each user has access to the video tutorials through a user profile. The user profile is created when registering on the site. The user profile is used by the user to access the video tutorials on the site. A user profile can only be used by one customer. If it is detected that two users use the same profile to access the lessons, we have the right to close the client’s user profile.

 

Intellectual Property Rights-Products from the Market

  • you do not resell, rent under any kind of any of the products that you have purchased / downloaded from the site 3dlab.bg and / or are owned by 3D Lab Academy Ltd.
  • do not include the Products in groups with other products you sell
  • you do not distribute Product (s) or its modifications (even parts of the respective Product (s))
  • do not use our Products in projects that are not protected from retrieval of a Product from other users
  • do not use textures in logos, watermarks or trademarks of any kind.

 

Our Products cannot be used to create logos and trademarks of any kind.

 

  • You can use the products from the section Freebies in your personal, commercial and educational projects, if you do not violate the rules defined in the “Terms of Use” of the website, and the following basic principles:

  • do not include the Products in groups with other products you sell

  • You cannot use 3D models from the 3D lab in scenes that you sell, give away for free, or include in packages with other products.

  • You cannot violate the rules defined in the “Terms of Use” of the site, namely the following basic principles:

LOYALTY PROGRAM “3D LAB UNION”

3D Lab Union is our loyalty program, with which we, the team of 3D Lab Academy have the opportunity to thank our customers for their support and understanding. By participating in the program you will have the opportunity to enjoy big discounts, based on points earned.

The points that are collected and used for a direct discount are called “Gems”. For each item corresponds a certain discount from the next purchase on the site. These points can be used only in our website 3dlab.bg to generate a discount and do not make sense of any virtual currency. For every 1 euro with which you have paid for a product on the website 3dlab.bg you will receive 10 Gems (exchange points).

Gems (exchange points) are automatically generated based on your purchases on the website 3dlab.bg according to the total amount of the order and then automatically added to your personal profile, which also means that the accumulated points can be used only by you through your profile.

During the order process of a Product from the site 3dlab.bg there will be a section in which you will be able to make an active option for using a discount with the accumulated gems (exchange points).

For every 1000 gems you can use a discount of 4 leva. The maximum percentage discount on the value of the entire purchase can reach 80%.

Gems do not have validity over time (they do not expire), you can accumulate and use them as you see fit.

At any time, the User has the right to refuse to receive these emails via the “unsubscribe” button in the sent email or by contacting us at the specified contacts.

In case 3D Lab Academy EOOD suffers any damages as a result of actions or inactions of Users who have concluded a training contract and / or purchased a product from the market (regardless of whether the product is paid or free), Consumers are obliged to fully compensate 3D Lab Academy Ltd.

In case, as a result of actions or inactions of Users, third parties file claims against 3D Lab Academy EOOD, the specific User or Users, due to whose action or inaction the claims are filed, are obliged to compensate and be fully liable to the third party.

 

Disclaimer

Final provisions

The invalidity of individual clauses of the training contract does not lead to the invalidity of the entire contract. By downloading, installing, accessing, copying, uploading, or otherwise using a Product, you understand and agree that: (a) you create a direct relationship with the provider or author of the Product (“Publisher”) under the associated end user license agreement or other agreement applicable to such Product (each, a “License Agreement”), independent of your relationship with 3D Lab Academy under the terms of agreements, or terms of use, governing your use of other generally available 3D Lab Academy products and services, (b) your use of the Product is governed by the applicable License Agreement and not the terms of any other 3D Lab Academy agreements, or terms of use, governing the use of other generally available 3D Lab Academy software products and services, (c) your personal data/information (e.g., first name, last name, email address) will be made available to Publisher for fulfillment purposes, and (d) personal data/information collected through the Product is subject to Publisher’s privacy policy.

 

  1. Site; Products. The Site makes available for download certain Products. You may use the Site to browse, locate, and download Products to be used in connection with your licensed 3D Lab Academy products or services.

 

  1. License Agreements. Use of the Products is governed by the terms of the applicable License Agreement. You may not install, access or use any Product that is accompanied by or includes a License Agreement unless you have agreed to the terms of the applicable License Agreement. You agree to comply with all local laws and regulations regarding the download, installation and/or use of the Products.

 

  1. Third Party Products. Many of the Products made available for download on this Site are sourced from independent third party-developers or providers (“Third Party Publishers”), and not from 3D Lab Academy. Each Third Party Publisher is solely responsible for its Products (“Third Party Products”), including, without limitation, for (i) any and all content, services or subscriptions provided through or in connection with such Third Party Product, (ii) the development, installation and use of such Third Party Product, (iii) any and all maintenance and support services with respect to such Third Party Product, as specified in the applicable License Agreement or as required by applicable law, (iv) any and all warranties for such Third Party Product, whether express or implied by law, to the extent not effectively disclaimed in the applicable License Agreement, or other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty, (v) the investigation, defense, settlement and discharge of any liabilities or claims by you or any third party in any way related to the Third Party Product, including, but not limited to, for product liability, personal injury or death, noncompliance with applicable law, rule or regulation and infringement or misappropriation of a third party’s intellectual property or other rights, and (vi) establishing the purchase price, verifying all payments, collecting and paying all applicable taxes and issuing refunds. Please contact the Third Party Publisher directly for refunds, returns or cancellations relating to Third Party Products. 3D Lab Academy reserves the right (but shall have no obligation) to screen, review, filter, modify, refuse or remove any or all Products from the Site.

 

  1. Payments. Some Products may be available to you at no charge while other Products may be purchased for a fee. You agree that you are solely responsible for all fees associated with purchases you make on the Site. If you wish to purchase a Product, we may provide, for your convenience, a link on the Site to a payment processor who will process your payment for such Product (“Payment Processor”). Please be aware that the Payment Processor is a third party, and that use of the Payment Processor’s website and related services is governed by the Payment Processor’s terms and conditions, not by these Terms, and 3D Lab Academy is in no way responsible or liable for the Payment Processor’s terms and conditions. We encourage you to read the Payment Processor’s terms and conditions prior to making any purchases. You agree that 3D Lab Academy reserves the right to add or remove payment processing methods at its sole discretion and without notice to you.

 

  1. Waiver and Release. 3D Lab Academy is only responsible for providing access to the Site and for making available Products via the Site under the terms of their respective License Agreements. 3D Lab Academy shall have no responsibility or liability whatsoever in connection with Third Party Publishers and/or Third Party Products and, to the maximum extent permitted by applicable law, you hereby release and waive all claims against 3D Lab Academy and/or its subsidiaries and affiliates and each of its and their respective employees, officers, directors, shareholders, agents and representatives from any and all liability for claims, damages (direct and consequential), costs and expenses (including litigation costs and attorneys’ fees) of every kind and nature, arising out of or in any way connected with Third Party Publishers and/or Third Party Products.

 

  1. Disclaimer of Warranties. THE SITE AND THE PRODUCTS AVAILABLE THROUGH

THE SITE AND ANY OTHER INFORMATION, CONTENT, SOFTWARE, DOCUMENTS,

AND RELATED GRAPHICS PUBLISHED ON THE SITE COULD INCLUDE TECHNICAL

INACCURACIES, ERRORS, OR OMISSIONS. CHANGES MAY BE PERIODICALLY

MADE TO THE INFORMATION HEREIN. 3D LAB ACADEMY AND/OR ITS RESPECTIVE

SUBSIDIARIES, AFFILIATES, SUPPLIERS AND LICENSORS MAY, BUT ARE NOT

OBLIGATED TO, MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE, THE

PRODUCTS AVAILABLE THROUGH THE SITE, AND ANY OTHER INFORMATION,

CONTENT, SERVICE(S), SOFTWARE, PRODUCT(S), DOCUMENTS, AND/OR THE

PROGRAM(S) DESCRIBED HEREIN AT ANY TIME.

 

  1. General. You hereby acknowledge that you shall have no power or authority to assume or create any obligation or responsibility on behalf of 3D Lab Academy. Any failure to enforce any provision of these Terms shall not constitute a waiver thereof or of any other provision hereof. If any provision of these Terms is found to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provision. You may not assign, transfer or sublicense any or all of your rights or obligations under these Terms without 3D Lab Academy’s express prior written consent. 3D Lab Academy will not be responsible for failures to fulfill any obligations due to causes beyond its control.

3D Lab Academy reserves the right to change these Terms from time to time, and provide you with notice of such change by posting a revised version of the Terms on the Site or by other reasonable means selected by 3D Lab Academy.

The above agreements may be translated into other languages, but Bulgarian is the official language of this agreement and in any conflict between the Bulgarian language version and any other version, the Bulgarian language version shall control.
These Terms and Conditions are in effect as of January 01, 2020.
